Acceptance of User Agreement
This User Agreement is a contract between you, the person or company using our services, and Loadbid (ABN 99 065 303 193) which operates the www.loadbid.com.au website (“LoadBid”). Please carefully read the Terms and Conditions below which constitute the User Agreement. Upon completion and submission of your registration details, you are deemed to have understood and accepted this User Agreement. LoadBid may amend the Terms and Conditions from time to time and so it is recommended that you regularly check for any updates.
If you do not agree to any of these Terms and Conditions you should not register with LoadBid or cease to use LoadBid immediately. Please note that we may suspend or discontinue access to your account on LoadBid if we feel you carry out activities or have made actions which are in breach of this User Agreement.
1. USER ELIGIBILITY
LoadBid is available only to individuals or corporate entities that can form legally binding contracts under applicable law. LoadBid is not available to persons under the age of eighteen (18).
LoadBid offers its services to advertisers and service providers (both referred to herein as “User”). LoadBid shall have absolute discretion as to whether or not a particular Users registration is accepted for use of LoadBid. By registering with LoadBid, the User agrees that the information provided:
i. is true and accurate;
i. is not false or misleading;
ii. is not contrary to any applicable laws;
Registration with LoadBid is free and you are not obligated to advertise, bid, or accept any job. You are responsible for ensuring that your registration and login details are kept confidential and that no one else is authorised to use your account. Users are responsible for what occurs on their account and must report any unauthorised use of their account to LoadBid immediately. You must not create multiple User accounts.
3. USERS RESPONSIBILITIES AND TRANSACTIONS
LoadBid provides a virtual forum for Users who wish to advertise jobs, and Users who wish to provide their services to fulfil these jobs. Upon the advertiser accepting an offer from a service provider, both parties are responsible and legally bound to complete the transaction directly between the parties and by mutual agreement. Cancellations of the agreement after the conclusion of the bidding activity are at the discretion of the Users. For the avoidance of doubt, LoadBid has no responsibility to assist, supervise or enforce the transaction. All prices on LoadBid are in Australian Dollars (AUD).
4. INDEPENDENT CONTRACTORS
Users acknowledge and agree that they are in no way considered as entering into an agreement or that the transaction is a partnership, joint venture, or employment relationship created between the advertiser and the service provider.
LoadBid does not guarantee that the information provided on the website or advertised by the Users is accurate or reliable. You agree to indemnify and hold harmless LoadBid (and all related entities) and acknowledge that all risk and liability using LoadBid remains with the Users at all time. Users are responsible for satisfying themselves as to the quality of information and suitability of services provided. To the extent permitted by law, Users release and indemnify LoadBid against all claims for any consequential costs, damages, or direct losses as a result of misleading or inaccurate information, incomplete transactions, and professional services offered or delivered.
LoadBid may, but are under no obligation to, monitor content on the site and retain the right to reject, amend or approve any content at its absolute discretion.
6. TECHNOLOGICAL ERRORS
LoadBid is an online service and may be subject to unforseen delays, outages, interruptions and other time-sensitive issues from time to time. Information provided on LoadBid including User activity such as bidding, may be affected by these issues and may change without notice. To rectify any errors, LoadBid reserves the right to re-start, extend, retract, amend or approve any advertised job or bid made.
7. BIDDING AND FIXED PRICE ACCEPTANCE
If you are unclear about what is advertised on LoadBid and you require further information before committing to the advertiser, please do not bid or accept the fixed price. As a service provider, when making a bid or accepting a “fixed price”, you are accepting the offer and entering into a legally binding contract with the advertiser. The act of bidding or accepting a “fixed price” is solely the responsibility of the LoadBid account holder, and you agree that anyone using your account is authorised to do so. LoadBid asks for a confirmation of your purchase decision and as such does not accept accidental bidding/acceptance. Once confirmed, the bid is considered live and not retractable.
8. APPLICABLE LAW
The law of Victoria from time to time governs this User Agreement.
